Özet
Bu çalışmada toplumunun en önemli kurumu ve yapıtaşı olan aile müessesesinin temelinin atıldığı evlilik sözleşmesinin gerçekleşmesi ve sonlandırılması üç Şiî mezhebi bağlamında karşılaştırılmalı bir şekilde ele alınacaktır.
İnsanlık tarihi kadar eski olan aile müessesesi, bir kadın ile bir erkeğin kendi
iradeleriyle tam ve sürekli bir yaşam ortaklığı kurmak üzere dini veya hukuki
şartlara uygun olan bir sözleşmeyle kurulmaktadır. Eşler arasında yapılan bu
sözleşme ile gerek eşlerin birbirine karşı, gerekse aile fertlerine karşı hak ve
sorumlulukları tespit edilmiş, aile yapısının sağlam temeller üzerine oturtulması ve ailenin sağlıklı bir şekilde varlığını devam ettirmesi amaçlanmıştır.
Yazılı hukuk kurallarının olmadığı dönemlerde evlilik sözleşmesi toplumun
tabi olduğu örf ve adetler doğrultusunda gerçekleştirilmiş, sözlü kurallar ve
toplumsal geleneklere bağlı olarak sürdürülmüş, eşler arasında baş gösteren
anlaşmazlıklar yine bu kurallar çercevesinde çözüme kavuşturulmuştur. Evlilik sözleşmesinde, toplumsal hayatı düzenleyen ve toplumun işleyişini kolaylaştırmayı amaçlayan örf ile âdetlere uyulmaması durumunda uyarma, kınama gibi müeyyidelerin yanı sıra henüz yazılı hukuk sistemlerinin bulunmadığı
bu dönemlerde birtakım cezai müeyyideler uygulanmıştır.
In this study, the different points of the realization and termination of the marriage contract, in which the family institution, which is the most important institution and building block of the society, will be discussed comparatively in the context of the three Shia sects. The conjugal union, which is as old as the history of mankind, is established by a man and a man joining in accordance with a religious or legal agreement to establish a full and permanent life partnership with their own will. With this contract between spouses, the rights and responsibilities of spouses against each other and family members have been identified, it was aimed to establish the family structure on solid foundations and maintain the family's healthy existence. In periods when there were no written legal rules, the marriage contract was made in line with the customs and traditions that the society was subject to, and verbal rules and social traditions were maintained and disputes arising between spouses were resolved in line with such rules. In the marriage contract, in case of disregarding the customs and traditions, regulating social life and aim to facilitate the functioning of the society during these eras when there were no written legal systems yet, besides sanctions such as warnings and condemnations, a number of criminal sanctions were applied as well.
