Özet
Dünyanın önemli bir kesiminde günümüzde yaşanan kaosların yanı sıra bazı devletler tarafından öteki başka devletlere karşı silahlı kuvvet içeren müdahalelerde bulunulduğuna şahit olunmaktadır. Bu müdahalelerin uluslararası hukuka göre meşru olup olmadığına ilişkin uluslararası hukukçular arasında birtakım tartışmaların bulunduğu görülmektedir. Bu çerçevede, Birleşmiş Milletler Antlaşması’nın 2’nci maddesi 4’üncü fıkrasındaki düzenlemede kuvvet kullanma ve buna yönelik tehditlerde bulunulması hakkındaki yasaklar günümüzde de önemini korumaktadır. Bu nedenle, bu çalışmada uluslararası hukukta kuvvet kullanma yasağı ve istisnaları üzerinde durulacaktır.
In addition to the current chaos in a significant part of the world, it is witnessed that some states have intervened with armed forces against other states. It is seen that there are some debates among international lawyers about whether these interventions are legitimate according to international law. In this context, the prohibitions on the use of force and making threats regarding the use of force in the fourth pharagraph of the second article of the Unated Nations Charter, still maintain its importance today. Therefore, this study will focus on the prohibition and exceptions to the use of force in international law.
